Resumen: El presente trabajo indaga en la estrategia de producción
de principios que la Contraloría General de Chile ha diseñado, en
cuanto como órgano de adjudicación y resolución de controversias
entre la Administración y los particulares, para limitar el régimen de
invalidación administrativ a y dar estabilidad a las situaciones jurídicas
creadas por actos administrativos. De esta forma, el problema se
plantea en los términos y razones que la doctrina y la jurisprudencia
administrativa han dado para conservar aquellas situaciones jurídicas
surgidas de actos administrativos antijurídicos y, en consecuencia,
preferir la suspensión de la vigencia del ordenamiento jurídico en
casos excepcionales, develando el compromiso apócrifo que
representa el principio de legalidad de la actuación de la
Administración del Estado cuando se enfrenta al interés individual. Se
busca indagar en la realidad de la vida jurídica con el objetivo de
ofrecer nuevas consideraciones que nos permitan entender la praxis
jurisprudencial del Ó rgano Contralor, siguiendo como hilo conductor
los argumentos del jurista alemá n Carl Schmitt, para comprender el
arsenal argumentativo del principio de confianza legítima como límite
de construcción jurisprudencial al régimen de invalidación, detectando
sus funcionalidades e incoherencias internas, con miras a provocar un
análisis más profundo sobre los motivos normativos que lo inspiran.

THE PRINCIPLE OF LEGITIMATE TRUST AS A
LIMIT TO THE REGIME OF INVALIDATION IN
CHILE: BETWEEN LEGALITY AND DECISION

Abstract. This paper aims to investigate the strategy of production of
principles that the General Comptroller of Chile has designed, in its
function of adjudicating disputes between the Administration and
private plaintiffs, in order to limit the administrative invalidation
system and to give stability to legal situations created by
administrative acts. Thus, the problem is presented in the terms and
reasons that administrative doctrine and case law have provided to
keep those legal situations arising from antijuridical administrative
acts and, therefore, to prefer the suspension of the force of law in
exceptional cases, revealing the apocryphal compromise that the
principle of legality of the actions of administrative agencies represent
when confronting individual interests. It is sought to delve into the
reality of legal life with the aim of providing new considerations that
allow us to understand the jurisprudential praxis of the Comptroller
following the arguments of the German jurist Carl Schmitt as a
guideline to understand the argumentative arsenal of the principle of
legitimate expectations as a jurisprudentially constructed limit to the
invalidation regime in Chile, detecting their features and internal
inconsistencies, in order to provoke further analysis on the normative
reasons that inspire it.
