RESUMEN
La prudencia en las actividades humanas, en cuanto a la explotación de los recursos
naturales se ref‌iere, proviene de la conf‌luencia entre el cuidado del medio ambiente y
la participación de las comunidades, dentro de un Estado Democrático de Derecho que
sea respetuoso de un desarrollo sustentable. Así, en el contexto o tendencia mundial a
reconocer el derecho fundamental de los seres humanos a un medio ambiente adecuado
se ha ido convergiendo hacia una mayor participación ciudadana, íntimamente relacionada
con tres derechos, el de acceso a la información ambiental, el derecho a la participación en la
toma de decisiones ambientales de la Administración y el de acceso a la justicia ambiental.
En atención a lo anterior el legislador ambiental chileno ha dictado la Ley N° 20.600 sobre
Tribunales Ambientales, con el f‌in de dotar al sistema de una jurisdicción especializada en
esta materia. Este artículo trata diferentes temas atingentes como la aplicación de la ley,
legitimación activa y condiciones de igualdad ante estos tribunales, terminando con la
idea de que la Corte Suprema estaría llamada a proteger el medio ambiente en virtud del
principio precautorio, lo que se ref‌leja en alguno de sus últimos fallos.

SUMMARY
The prudence that humanity puts in its exploitation of natural resources is the result
of the conf‌luence between the protection of the environment and public participation
of communities, in the framework of a Democratic System and in respect of the Rule of
Law. Is because of this that the global trend of protection of the human right to a healthy
environment has converged in a call for more public participation, a mechanism that is
closely related with the three Access Rights: Access to environmental information, Public
Participation in environmental matters and Access to Justice in environmental issues.
Regarding all this, Chile has issued the Law N° 20.600, that creates the Environmental
Courts, in order to provide a special court for environmental issues. This article deals with
some important issues regarding this change, such as the application of the law, legal
standing and equality conditions in these courts, f‌inishing with the idea that the Supreme
Court it’s called to protect the environment in respect of the precautionary principle, as it
has been ref‌lected in recent decisions.
