Es necesario que el debate en torno a las aguas y su priorización comprenda a todos
sus usos. Este artículo formula, por medio del estudio de modelos comparados, una
modiﬁcación legal que establezca un orden de prelación en el uso de las aguas, que podría
constituir una solución a la regulación de sus múltiples usos.

Nowadays, a bill that reforms the Chilean Water Code is being discussed in the
Congress, bill that has been substantially modiﬁed in that process. This bill pursues to
establish the right to water and sanitation as priority use of water. In addition, it recognizes
the ecosystemic preservation as a function, as well as the productive function of water.
However, it doesn’t prioritize between this two. Given that situation, the productive uses
will be ruled by the current Water Code, meaning that whoever applies for the use of the
water for productive uses ﬁrst, will get the right to water (if the petition fulﬁlls the legal
requests) and, if there are two or more applications for the use of the same water, the DGA
will have a public auction, and the best bidder takes the right to use that water.
The debate that goes around water and it’s prioritization of use needs to comprehend
all its uses. The present article formulates, based in the study of compared models, a
legal modiﬁcation that establishes a priority use of water that could be a solution to the
regulation of its multiple uses.
