RESUMEN
La responsabilidad por daño ambiental en nuestra legislación ha ganado cada vez
mayor relevancia desde la instalación de los Tribunales Ambientales. De este modo, al alero
del título III de la ley 19.300, y del párrafo cuarto del título III de la ley 20.600, la acción
de reparación de daño ambiental es frecuentemente utilizada. En este sentido, uno de los
presupuestos esenciales en el ejercicio de dicha acción es la existencia de un daño ambiental
significativo. El presente trabajo plantea que el atributo de significancia exigido por el
legislador es un concepto jurídico indeterminado, cuyo contenido ha sido debidamente
delimitado por la jurisprudencia de los Tribunales Ambientales. De esta manera se ofrece
un análisis de los diversos parámetros desarrollados por el Segundo y Tercer Tribunal
Ambiental, en la búsqueda por dotar de un contenido efectivo el requisito de significancia
del daño ambiental.

ABSTRACT
The responsibility for environmental damage in our legislation has gained increasing
relevance since the installation of the Environmental Courts. Thus, under the heading of
Title III of Law 19.300, and of the fourth paragraph of Title III of Law 20.600, the remedy for
environmental damage is frequently used. In this sense, one of the essential assumptions
in the exercise of such action is the existence of significant environmental damage. This
paper proposes that the attribute of significance required by the legislator is an undefined
legal concept, the content of which has been duly delimited by the jurisprudence of the
Environmental Courts. In this way, an analysis of the various parameters developed by the
Second and Third Environmental Courts is offered, in order to provide an effective content
with the environmental damage significance requirement.
